Most attorneys use boiler plate when they can as the documents have been "vetted", in other words, there have been lawsuits and ideally the suits went before appellate and supreme courts to set precedent, that way the attorney's know exactly what the courts have upheld, thus the strength of their documents.  

There are ways to get creative with this, too, but you rely more on Supreme Court decisions.
