Its not criminal, unless you lie, and so you're not going to jail.Your accountant would have needed to calculate the cost basis when you converted to rental just to figure out the depreciation.

As much as it sucks for owners, PMs, and other tenants, just because we are LL does NOT mean we can suddenly magically control other people's behavior and get them to do something.
