My intuition is to hire a real estate attorney and have them draft up a letter stating that the closing is contingent on the release of HOA documentations and I am entitled to a refund of my deposit without those documents.

If you haven't already done so, make sure you put some details about your closing in this forum.One quick tip and something that I do, now that you closed and not sure if you found this deal via a broker relationship, but make sure you create a press release, letter, email or some announcement and send to all your broker connections, prospective investors and other people in your business database.You are now a closer and brokers want to work with closers.
