4% could work for me but if I go higher than that, I begin to loose cash flow in the property.

You may be at risk of loosing your EMD or at the very fight for it, but that is a separate issue and fight for another day. 

You are bound to the previous lease agreement so be sure to read it closely and abide by the rules stated.
