I think that argument would carry in many court cases unless there is more to the story.I'd encourage you to have written requirements that you can make available to applicants. 

Situations like this have been occurring a lot recently in a lot of different markets across the country.

I've done a decent amount of research into these markets but also spend a lot of my free time just reading every article I can find about the best vacation rental markets in the country and also reading through these forums to see what other people are saying.
