It appears to me that the real issue here is not from easement and ownership rights but the failure of the original grantor and grantee of that easement also providing a written Road Maintenance Agreement (RMA) to be filed which may also run with title.What you probably need is a RMA to define what standards of maintenance are agreed to between the owner and easement holder.
