It seems that the AG is saying, once all contingencies are lifted - meaning you pass your inspection period or add an addendum waiving your partners right to cancel the contract, or remove any other contingency you included, you then have equitable interest and thus the right to market.I was at a presentation last year where the speaker was the state lobbiest for the Virginia Association of Realtors.

As mentioned, an acq fee is customary in many syndications 1-2%, but this is on multimillion dollar purchase price, and that fee is typically associated with a lot of travel cost, due diligence work, etc and can be one or more persons full time salary, i.e. life effecting. 2% on a $300k deal is $6k.
