The courts would likely require the PMC to refund the tenant and then pursue you for reimbursement -> that would cost them time & money IF it made financial sense to hire an attorney to chase you.Kudos to @Adam Bartomeo for getting this right!

But what you're trying to do is get your new property under contract and then give yourself as much time as possible to get your SFs sold before you have to take title to the MF.Lastly, if you absolutely have to take title to the MF before all of your Sfs have sold you could pursue a reverse exchange where we form an entity that takes title to the MF and holds it until all of the Sfs have sold.
