Should I take the security deposit from them or closer to the moving date?

Should I just hope closing goes ok and not worry about the fact that both properties are still in the LLC's or could this haunt me if the closing goes ok but they catch the mistake at a later date?

When using hard money lenders you have a lot of variables; are they legit, if they are legit how many "points" do they charge, what interest rate, for what term, what are their "junk fees", do they actually fund, what is their policy if you can't pay off the loan at the specified date and so on.

Is it possible to do a tenancy in common with an expiration date?
