In either case, I would say most lenders will not allow the use of funds if its not for business purpose only and you definitely cannot owner occupy on a DSCR loan. 

The lender didn't go out of business, YOU are choosing to follow your mortgage guy to a new lender.

Easy flip with large profit How did you find this deal and how did you negotiate it?

I think will be extremely difficult for then to get money out of you but may be easy to get a free stay and claim any eviction attempts are retaliatory. 

I would suggest looking into a business line of credit if you need such little funding.
