They are also liable, in my opinion.Suing in civil court would get you more satisfaction, in my opinion.  

Its not widely known but if you have a problem and someone turns you in its an automatic 5k fine.. and if there is buyer litigation you really can have a problemthe nuances are Developer: you need not take a test you simply have to register your name or company.. you then have to get a 50k bond.. and you MUST have insurance..

You may need two, One that handles your real estate transactions and one that handles any construction related litigation and the use of mechanic's liens both for you and against you.

The problem is that litigation is lengthy and expensive (especially in California).

Under civil code we have 60 days to return the deposit, but I usually make it my policy to return the deposit with 2 weeks of move out.  

What I fear is the possible litigation if a child is injured playing in the yard.

I've followed many of their lawsuits and I wouldn't want to litigate against them.
