I would have a new agreement in your name as soon as you close, I would make sure the notice is in writing and correct for the county/state.

They chose to close up shop.Having worked at lenders, hearing complaints from folks like you, I can only say "seen it, done it", and if I was a lender seeing a guy with a good story, like "the numbers tell me I should net $1,000/month", take it with a grain of salt, but insist on maintaining your requirements, unless you're a billionaire and writing off $150 million is no big deal.

If you take money out ( or 1031 does not go successful for some reason) settlement company will write a check to you for same amount they received and it will be subjected to tax at that year (capital gain taxes if property was held for more than one year - 15 % otherwise I believe its 20%.)Will interested to learn more from other biggerpockets members from replies to this post.
