RDE is such a large company they are hyper sensitive to litigation so make their education so mellow that you could Google a topic and come away with as much info.

Seems everyone tries to circumvent real estate laws, that those are the only applicable laws in real estate.......absolutely not, you have the uniform commercial code, you have civil law and torts, advertising issues and fair dealing with the federal trade e commission, you have the securities and exchange commission in raising money, we have a string of consumer protection laws and all of this seems to be totally ignored by newbie wholesalers, not really addressing you Dio, but all of them on BP.A contract that is made to accomplish an illegal act is not a valid contract and that can be conspiracy as in conspiracy to commit fraud or some other criminal act!

Or in any civil action.

There is a state law (Kansas Open Records: K.S.A. 45-230) that state, "No person shall knowingly sell, give or receive, for the purpose of selling or offering for sale, any property or service to persons listed therein, any list of names and addresses contained in or derived from public records … Any person subject to this section who knowingly violates the provisions of this section shall be liable for the payment of a civil penalty in an action brought by the attorney general or county or district attorney in a sum set by the court not to exceed $500 for each violation.") that makes it illegal to buy/sell information obtained from public records for marketing purposes.

XX.ATTORNEY FEES AND COSTS: In connection with any litigation including appellate proceedings arising out of this Agreement, the prevailing party shall be entitled to recover reasonable attorney's fees and costs.

Bank #2 took owners to civil court in May (not foreclosure), won $300k judgement - then filed a satisfaction of the mortgage in Aug.

Legally, I believe I will have to make sure that the LLC has no pending litigation/lawsuits/etc. and get a release from the current owner from any liability caused previous to my acquisition. 

I work as a Civil Engineer and we do mostly large multifamily and commercial type projects, not knowing your specific local development rules/processes this may not be applicable.Personally I'd sell now.

@Jeremiah MooneyI would suggest you spend the money necessary to have an attorney review what you have done to make sure it will stand up to litigation.  

Might want to pay for a real estate attorney litigation consultation about 100 to see what might happen.
