You can still serve them, depending on your area file the eviction and send them to collections.  

Create one multi-member (e.g. husband and wife) Wyoming LLC as the Holding Company (tax filing entity) that has beneficial interest in the other two Wyoming LLCs. 

If they file for summary judgment in a judicial foreclosure state a lot of info will be attached to the motion. 

I think I understand, but to make sure:If I setup a 2 member LLC with my friend to contract the property, at that point it is not considered a security since we would both be active partners in the LLC and thus avoid the otherwise necessary securities filings?

@Adam Frantz before purchasing, if the unit is occupied, I ask for an estoppel to be completed if no hard copy of lease on file or lease is unclear and Addendum R plus proof of payment for the past 3-6mos.

Last Friday afternoon I was due to close on a cash out refinance, I spoke with the title company first thing and they told me they have all the documents apart from the settlement statement.The title company tried to make contact with the person who sent the files but they were unable to make contact.

All you need is to file a Fictitious Business Statement and then have your CPA get a Tax Identification Number from the IRS. 

Since you don't own the property you cannot make any major repairs or improvements to the property without the owner's consent because if you make repairs and don't pay the contractor(s) then the contractors will file a Mechanics Lien against the property and the owner will be liable to pay the contractors.If you do repairs to the property and you don't own the property the owner can sue you for destroying the property.Should the seller decide he (or she) no longer wants to sell the property because he either wants to keep it, or he can sell it for cash on the market then he will sue you in court for whatever his attorney can come up with and you can get sued just because the contract the seller wrote has some b.s. that makes in not valid.It doesn't matter whether you are right or wrong when  you get sued because when you receive a Sheriff serves you with a lawsuit you now have to make some serious and hard decisions in regards to whether or not you want to pay an attorney $50,000 to $100,000 to settle the lawsuit that often takes up to 5 years to settle in court.How do I know all this?
