Nothing the lender can do to trigger a due on sale clause based on a divorce decree.

Seller claims they never were served and Seller broker is not releasing based on Seller's word including saying they are seeking legal counsel (they have been seeking legal counsel since December). eXp MN state broker team has been unresponsive and very unhelpful throughout the process.

Now, apparently after some improvements, the building with the parking garage has been deemed structurally sound and safe to occupy (based on an engineering report and formal subsequent notice from the HOA).

I think communication and staying in contact shows effort and that’s big with most tenants.

I also don't have a knowledge base to truly understand the intricacies of what makes this market work and shift.  

They are reviewing the lease to see if we can get her out sooner based on the lease agreement.

If the property has not appreciated in the past couple of years I would be hesitant to keep the property based on long term appreciation. 

You can rent the property as is and base the rent off of the condition.
