However many properties are not insured and an owner may take insurance money and just not bother to repair the property.

You will be only losing an extra 10% on a penalty, which at 40, you have plenty of time to recapture if it bothers you.

I honestly don't know why anyone would bother to be a landlord in my area, you have to put 50% down just to breakeven on your cash flow, so you have ~$150k sitting dead in the hope that the house will appreciate.

Doesn’t bother me.
