I'm not an accountant, so I could be wrong, but here's my take...There definitely could be tax differences between doing the work upfront and doing it after the tenant moves in.

But I would check with the Virginia Fair Housing Office before I listed a property for sale with those terms.Also keep in mind, just because you follow every law to the T, does not prevent a potential buyer from making a Fair Housing complaint against you, which will take time and money to clear up, even if you did nothing wrong.
