I did have quad tenants break the toilet tank lid and stick plastic flowers in it, jamming and causing a month long toilet leak.

Then fill the rest of the way with clear gravel, not dirt along the perimeter a plastic drain membrane should be placed on top of the footer to at least an inch above the surface of the new cement floor.

If the fence is your proceed, it you removed it and wanted it gone it's yours if you do new it's yours, but I'f  make sure you put up some plastic temporary fencing if they have a dog, so their pit bull doesn't come over and greet you..
