He needs to investigate to see when the adverse use began and meet state requirements to claim the adjacent property.

This is in most cases nothing more than an issue for that lender to overcome that consent was given, many accepted the argument, some didn't (BofA for one, depending on the type of note).

What I have found to be the biggest thing to overcome is that dang thing called fear.  

The financing is definitely a possibly hurdle to over come because I understand there are not many lenders willing to lend on investments that indeed depreciate rather than appreciate over the years.

Many of these aspects can be overcome, if you don't speak english, take someone with you, just smile alot while they translate.After you put together a list of your personal assets, strengths and weakness /short commings, then you can better identify how, when and where to get started.

You need credit, income, knowledge/experience, collateral and assets to be considered for financing in RE, if you lack in one area, you need to compensate in another area, but the ability to repay and collareal can't be completly overcome with other aspects.

I think it is great for young interested investors like myself to hear these stories and to remind ourselves that everyone starts somewhere and to hear some of the learning curves that others had to overcome on their road to success!

. :) Bill Gulley - that's a clever approach that has already been suggested to those who face HOA restrictions on rentals; so gov't restrictions could certainly be overcome similarly (until they re-do the ordinance).

I don't say this to discourage you at all,  just to understand the market and how to overcome.

It is true, the equity investor can absorb more of a reduction than that of the debt guy but adversely and in proration to the amount invested, the debt guy doesn't need to make as much.
