Why do lenders view this different from gifted funds and what needs to be done to differentiate it?

You might get lucky and they may leave.You will attract a higher quality tenant if you avoid section 8 by setting your screening standards higher.

I have not done so, but I have negotiated this with an individual as seller when the final walk thru (outside of the inspection period) revealed damage that had been hidden by the occupants furnishings during original viewing and inspection period.

The high end market has slowed down, but the property is actually cheaper than some comps in the building on a per foot basis and actually has a very nice view.

In the situation where the parents are exchanging into a TIC in the replacement property, this seems to be a different situation since it's actually the parents LLC which is taking title to real property via the TIC, so if an heir was to invest in the property as an LP I feel the IRS may view this differently but am not sure.
