As the seller, you can definitely throw a contingency to the buyer that if they don't get their documents squared away by ##/## date, you are going with the next best offer.

In our case, we know we can't wholesale without a solid 2 weeks with the property so the last piece of mail arrives 20 days from the auction date.

Everything I have done to date has been conventional, lease optioned, or seller financed, so entering somewhat uncharted territory.Mentor recommended having a Personal Financial Statement (PFS ), a couple of check stubs from the day job and last years tax returns.

(but looks like you would for first month)...so back to your situation, which is not clean, but check your state rules and verify without the signed lease, you reverted to the month to month, so I would really document and communicate the end of June move out date (like verbal plus a follow up more formal looking letter) and prepare for the move out then and the painters, etc to come in..

I have found a property that the owner:  1) has clear title; 2) property taxes are current; 3) the HOA has assessed a Notice of Trustee Sale; 4) Since the filing of the HOA NOD, I have also calculated the HOA dues and assessments that will have to be added to the potential investment. 6) Reviewed California Law on waiting periods for a) owner's termination rights, (NOTS 90 day redemption period - starts from date of sale). b) renters with and without lease contracts or if the homeowners is the occupant .My Questions: Please respond with answers applicable for California Law 1) If there isn't a 1st Lien in place or recorded, then I can assume most likely one doesn't exist?
