It appears that she may be telling the truth as the deed is signed in 2018 and notarized in 2021.Upon getting served I had my Lawyer look into the guy that sold me the property and it seems like this is not the first time something like this has happened with him, it also appears that this guy knows the lady who is claiming that she never signed the quit claim and they lived at the same address over 10 years ago at the same time.

I know underwriters want my debt-to-income ratio around 43% maximum (including the new mortgage) in order to approve a new mortgage.From what I've read, it appears underwriters will consider a certain amount of rental income in my favor, but only 75% of rent minus expenses.

So in one sense the intent that you can demonstrate easily is that you intended to hold it.There is one large court case in the last few years where a developer had his 1031 overturned on a property he sold after something like 12 years.
