Our policies are clear cut with rents that we have our Property manager enforce, due on the 1st, late on the 3rd, posted on the 5th, eviction filed on the 9th!

But if you receive a 1099, I'd be surprised if you don't file a Schedule C? 

If the property is held in a LLC and you need to file an eviction, you cannot handle it yourself, you would need to hire an attorney.

My understanding is you can still serve notice and file for eviction.

I would then file in small claims(JP Court).
