I'd also demand an appropriate concession from the seller, although that would reduce your damages and therefore reduce the E&O claim.However, if the worst assumption is true and the Realtor actually knew there was a lease in place and intentionally hid that fact from you, I'd not only go after his E&O, but also file a formal complaint with the Real Estate Commission.If you don't have satisfactory results prior to closing, I'd talk to your attorney about refusing to close until the situation is resolved to your satisfaction.
