I think there are some tax effects to a HELOC vs. a traditional mortgage, in that HELOC interest may not be tax deductible. 

@Leah Roberts I am not a lawyer but my understanding is a land contract title does not transfer until all payments are made.

I reluctantly accepted the offer as small claims will not enforce a payment and tenant could have appealed a loss and escalated this to superior court where lawyers would be running the show and I would ended up with nothing. 

New homes are much more attractive because the financing is better for buyers (and yourself if you dont have the option - the CASH program from Clayton is an effective way of doing this).

Just to make sure we have all of our bases covered, we've also sent a certified lease termination notice effective for her scheduled move out date just in case for some reason her lease falls through we won't be delayed any longer.
