Its very hard to protect yourself when you are bird dogging (bandit signs, d4d etc and passing the info to someone else) for someone because even if you sign some sort of contractual agreement, its worthless if you cannot afford to enforce it.

If held for 10+ years you get all of the benefits of the legislation and as you said, all of your gains would be wiped out if sold (actual language is that your basis is increased to the FMV of the property on the date of sale).

Of course, enforcement is not always practical as you can't be there all the time.I mostly control occupant count by parking spaces.
