If so that might impact from a state perspective but not technically federal.An LLC that only has one member (the joint return of a husband and wife) and elects to be taxed as a sole proprietor, is a disregarded entity and the IRS views the joint return as the true tax payer for property owned by that LLC from a 1031 persepctive.

I also think it is a good idea to minimize your taxes now, while positioning yourself the best you can for the future (where everything is an unknown).It certainly would not be a bad thing to also use your retirement accounts to invest in real estate (as long as you are very careful to follow the rules- avoid self-dealing!).

I would ask the lender, but probably not most lenders want you to have skin in the game, even the seller takes on a lot of risk if you don't pay, because they would not be first loan position
