Research how many homeowners are in lawsuits with builders over quality issues in newly built homes.If construction has stopped before the property is dried in (has walls, roofs, doors and windows to the point they keep weather out), the framing has been exposed to the weather.

If nails are popping up you will likely have rot in the decking, not just a new shingle job any longer..The chimney sounds like it really needs attention if the appraisal or what ever report you're reading states that it needs professional attention, doesn't sound like a point tucking issue any longer!

The refrigerator was so toally disgusting with dried food it took hours to clean.I am considering taking her to small claims court because she has a steady job and I think considering the damage she has done, should compensate me financially for the lost rent and the hours of time and labor and materials it will take to get the apartment back to the condition it was in when she rented it.

Either that or the overflow valve was "dry and cracked" so when the water did get to the overflow valve it went through the cracks in the valve and therefore dripped through to the first floor.
