I expect a 4 month turn around with build time and sell.If I ask a private investors for the cash what would be good terms if I asked a hard money lender what would be a win win situation.

It sort of seems like a win-win for a newer investor like me.

If we do this we short ourselves on our lien but could make it up on the sale of the unit if we win the bid.

If I give money to a flipper to buy at trustee's sale, he wins bid, tells trustee to title in his LLC, I get note and deed of trust from his LLC same day, I record deed of trust, he gets trustee's deed let's say 15 days later, he marches down to the county recorder and records trustee's deed, will my deed of trust that was recorded 15 days earlier attach and become a lien, or do I have to wait until the trustee's deed is recorded before recording my deed of trust?

In the event that you do try to sue him for damages and win, what money will he have to pay you?  

From what I read if i didn't win my 10k deposit would roll over to the October auction but since I did win will I need a new deposit?
