Show up with clothes and a sleeping bag at the management office and make your self at home . tell them you have to live there until the problem is fixed .

@Wen Chuang  I had an apartment once where they stated in the lease that the basement was not to be converted into any type of sleeping room due to the lack of proper fire escapes.

The problem is... we're in mASSachusetts.I served the problem tenant with a 30-day notice to quit for:- failing to pay a portion of her rent- having a large, loud dog in the unit illegally- noise and disturbance to other tenants- excessive wear and tear (explained below)Prior to this notice multiple issues transpired throughout the year:- She kept complaining about things breaking in her unit like clockwork every 2 weeks or so (at first I thought it was due to deferred repairs by previous landlord)- After I increased the rent (and her portion went up slightly), she called about an "emergency" (broken toilet), I immediately asked for a photo to figure out whom to send, the problem was that "someone" in her unit ripped off the lid.

Mine specifically says "Tenant agrees not to cause or allow any noise or activity on the premises which might disturb the peace and quiet of another resident or neighbor."

That said, I try to point out that variable rates will most likely go up over the next 5 years and the fixed rate may be the safer bet and allow you to sleep a little better at night.Regarding the balloon 5 years out, as long as the loan has been paid as agreed and the bank is still in business, the bank will generally want to keep the loan on the books and offer competitive renewal terms.

So for me, I'd walk - especially because your numbers already seem tight and this will almost certainly affect appreciation (just the uncertainty of future reclassifications will - even if you actually manage to get it changed to X now).I know it hurts to walk away when you already poured good money into the deal (I've done it myself with an underground oil tank situation), but that may be the cheaper solution in the long run - or at least the solution that lets you sleep better at night.
