I by no means want to take the IRS code for granted, but just like a math problem, given the general scenario i presented, there is a set of variables in a formula and there can only be one right answer .

I've found that novice investors don't know the ins an outs of a lease option deal, and people selling their own homes as a lease option are in the same category usually - the terms they utilize will oftentimes grant the buyer equitable interest in the home, and/or a violation of the dodd frank act. 

Is the driveway mutually shared or are you granting the easement to the neighbour (or vice versa)?

Granted that wouldn't be an issue if the property was sold for under the asking price.

This enables you to sell quickly so you can redeploy your capital to the next project.I know we were very blessed on this first deal and I don't take that for granted.  

Bear in mind, once foreclosure is granted the property goes to auction.
