@LeeAnn Doppel I'm not an attorney nor is this legal advice, but I think you are getting bad counsel.Your tenant communicated to you that he was prepared to go through the entire eviction process by text and filed some sort of challenge with the court.  

WOULD A NATIONAL CHAIN VERBALLY COMMUNICATE THIS PROBLEM OR COULD THE SELLER BE UNWILLING TO PRODUCE THE NOTICE?

Since the signing of the purchase agreement, the developer has limited communication to all buyers regarding the overall progress.
