They can put additional earnest money but in reality you are flipping the contract for an assignment fee, so your documents should reflect that.Good luck!

The way people get caught is when they change their insurance coverage to reflect that the property is a rental (which you SHOULD DO, by the way, or else a LOT of potential issues will NOT be covered).

Therefore, once he is gone - you should not have to worry about replacing the locks being considered constructive eviction (as long as you give the keys to the other tenants that is....)YES, you should definitely issue a new lease to reflect the change in the named tenants.

I realize this thread is a year old but the discussion still reflects our current situation.We have a 1/1 upstairs Condo and our Lease Agreement states any people living there in addition to the named Tenants will result in $150 additional rent.
