HUD issues cease and desist orders like a cop writes speeding tickets and beating it is much harder than a speeding ticket.I'm not digging up past threads, they can be found, but in administrative hearings they can clean your clock and role you into bankruptcy trying to pay an attorney, if you can find one, to take the matter up.In the other thread, examples were given that may constitute a loss or delay, how damages can be applied and how a wholesaler can unknowing become liable in a foreclosure situation.I understand your interest in this matter, selling lists of foreclosures, probably a good lead source.

Of course, if I sell the property in the next 5 years (and never have to do those capital replacements), my OE will likely be much lower than 50% during my entire hold time (possibly as low as 25-30%), and many people might assume that that means the 50% rule/guideline/theorem/law/whatever is meaningless.I think this is why people who don't tend to agree that expenses generally fall in the 45-55% range have this idea...they haven't extrapolated out far enough in their analysis of the actual costs of holding a property.I don't know many people who extrapolate out their expenses for the next 30 years, but luckily the 50% _____ does a good job of approximating that for them.To me the 50% rule is a good rule of thumb, just like the "if you're not more than 10 MPH over the speed limit, you probably won't get a ticket" rule of thumb.
