on another topic but along the same lines.. last year we actually won a specific performance case.and we see people on BP talk all the time about hey just sue for performance.. well I can tell you that is much easier said than done if the seller is a no show and just wont communicate.We had to put full cash sales price into escrow day of closing ( six figures and to prove we had the money) we had to let it sit there for the 2 years it took.seller never accepted service so we go for a summary judgement that's denied..
