A home and the debt is not included.A BK where a borrower is freed of their debts and the assets are liquidates is a different alternative.Lenders are allowed to restructure loans with a borrower.

I also recommend the book cited.If you are sued and the lawyer chooses to move forward they will ask you a series of questions about the debt vs. the equity and your other assets.

Once escrow is opened, both buyer and seller have to authorize any changes in escrow instructions.Typical seller paid items:Deed preparation; existing mortgage and accrued interest; transfer taxes; commission; title insurance; repairs based on termite inspection report.Typical buyer paid items:Hazard insurance; document preparation fees; survey; mortgagee's title insurance; credit report; loan origination fee; prepaid mortgage interest; discount points; Recording fees (deed and mortgage); termite inspection.

Also wanted to add that if you do not have the staying power to weather a storm when things do not go as planned then real estate investing might not be the right thing for you.Unlike stocks, real estate is not a liquid asset.

If interest rates go up or down the lender can change what they earn and better line up the interest income vs. what they bank has to pay out to the folks who give the the money (depositors, wholesale money lenders).The other alternative is for the bank to sell the loan to someone who has cash and wants to hold a long as an asset (investing in loans) to collect the income.
