So you could put make the investment in remodeling the space knowing that the returns will come to you (as long as you stay current on your mortgage, obviously).If you take your idea of remodeling the space before you have a contract and ask him to foot the bill, what's to say he won't do it and then keep the property to himself?

Lawsuits over this have been battled out; a federal court decided that process being used by PGW was unconstitutional (owner's rights to due process being denied), but the concept of the owner having to foot the unpaid bill was not ruled unconstitutional (so a better process that does not deny due process could put the unpaid PGW bills back as the owner's obligation).

Upon inspection there was barely a foot of clearance to the top of the tank, however this could be due to rainwater seeping in due to an ineffective seal and it likely needs maintenance due to the baffles potentially being clogged.
