This doesn’t leave much time considering it could take a day or two to open escrow, receive escrow instructions, receive a preliminary title, generate the note, deed of trust, perhaps an assignment agreement, have them signed, notarized as appropriate, reviewed by the IRA company, and then wire the funds.

That doesn't preclude using a DILF as recourse after default occurs, just be very, very careful having a signed and notarized (but unrecorded) DILF "hanging around" as part of your process.

If you get blindsided on the day of closing by an unwilling Seller or Buyer then you probably weren't babysitting the deal well enough.Now if your question was referring to someone not actually being ABLE to get to the closing table (like an out of town or imprisoned seller) then documents are normally emailed/mailed to them, executed and notarized (they do have notaries in jail), and then over-nighted back.

Even though the deed is not technically in the builder's name, shouldn't the executed and notarized land contract be sufficient to establish the chain of title to the builder and in turn, allow the builder's buyer to purchase using FHA?

The power of attorney needs to be notarized at the US embassy in China.In anticipation of purchasing the property we're having the brother wire the funds into his US bank account first way before close of escrow so we don't have to do any last minute fretting about the funds.My title officer was a great resource for answering these questions since she's had to close a number of transactions with foreign nationals.

Now with a contract you can still get cut out of a deal, thats why its good to get a notice of contract notarized by the seller and get that recorded, but without even a contract your just opening yourself up for failure...
