When one owner conveys an interest in title from joint tenancy to a new owner, joint tenancy automatically changes to tenants in common or fee simple absolute or similar ownership recognized in your state if you are the sole owner.

If it can be proven tenants caused the damage by overloading and you warned them in writing that if it occurs again they would be liable or repairs, then yes, you have a case for billing them.
