The court's decision, in favor of the city unfortunately, can be found under Section 1d(3).Though I am not an attorney, it appears as if the city has found a way to limit property flips and wholesalers.

While escrow and title can prepare a basic note and deed of trust for you, I suggest spending a little on some legal help and get some advice about creating a note with terms in your favor.

-In the end instead of a 60k loan the borrower had a 340k and the borrower stated he wasnt comfortable with the loan beforehand but stated he had hoped that the bank would see his act as a favor upon the bank and lender responded with "lets wait about 6 months for the smoke to clear and we will see about getting you a line of credit"-The blanket loan balloons in just a year.

The standard Beneficiary Agreement stipulates that any such amount proven to be owed to the defaulting beneficiary is to be paid...in the form of an unsecured promissory note, which note shall be retired only upon disposition of the property at the trust’s termination.Although it may seem to some that the default provision described here is weighted in favor of the investor beneficiary; it actually is not.
