If you location requires a certificate of occupancy before someone can live there, you will need to get the proper permits and finish up the inspections to get the COO.

You should video record this as well.To your specific question, It really depends on how hard you want to play.If it really is just a communication issue, work through it and explain you are unable to do your due diligence without the certificates and copies of any leases and would be unable to close the sale due to the seller's deficiency.That is the softball way.If you want to go hardball you can send him formal notice reminding him you relied solely on his representation of the condition of the leases.

Agreed that it's a good idea to leave it to legal representation to sort out.Their attorney replied this morning saying that a certificate of occupancy was issued by the Town so the presumption was that the Building Inspector had inspected and found all construction to be compliant which would include insulation.

So the buyer's selected title company orders a tax certification (that is paid for by seller) and the tax cert shows that nothing is owed to the TCB - but the title search finds the lien that was missing a satisfaction and so the title company wants me to take care of that lien.
