Hold harmless clauses and insurance don't prevent a lawsuit, they are simply layers of protection.  

It seemed a little short sighted to setup an LLC to protect my assets yet not be willing to pay a small fee to have a professional involved to ensure the LLC was established correctly.  

Its best to have him/her look everything over to make sure you are protected.

Real estate agents have a fiduciary duty to protect the sellers interests but a wholesaler has no such duty.For example a wholesaler is not required to present each offer to the seller but an agent or broker is.Furthermore, any profit or loss on the transaction is realized exclusively by the wholesaler.
