If so does that mean I now have to modify the sales contract and get the buyer to sign it again?

In nearly all cases, buyers sign at closing a statement that they intend to occupy for at least a year.  

If she doesn't have a bank account, its the tell sign of only the beginning of issues. 

You do not tell them a more qualified candidate was selected.
