One can wholesale without assigning and when done constructively I don't know of a single law that prohibits it. 

Don't try a net listing, too many liabilities, don't know that it's legal in FL, and your broker likely prohibits them anyway.

The fact that you are responsible and you intended to default are relevant.But the larger point is that people delve into these gray areas which they think are not expressly prohibited by statutute and they think they are safe.
