I don't say that US will ultimately crash and burn but unless we take some serious (unpopular) measures in reverting this situation I don't see how we will survive the ultimate catalyst - the moment when US $ is not the world reserve currency anymore, as @Eric Bilderback pointed out. 

It's the "safe" way for the trustee who gets a paid a percentage and he has less to explain to the court than if additional liens survive a shortsale.

And it takes a very savvy investor or people who have plan B and C and D to survive in a declining market.

I suspect the terms of the contract do not survive a closing so suing on its terms would be difficult.
