You need a seller who has standing, that is, Capacity, Powers, and Authority to pass title.So, someone with either need to become appointed administrator or follow as zip your process that your state IL may have for an informal or summary probate.

It's rather pointless trying to lead the blind if you are not a visionary (sorry).Until a property has a principal or someone with standing (capacity, powers and authority) to sell, encumber or oasis marketable title, it's pointless to plan too far ahead.

I've done this exact same transaction (even R/M in default) many, many times in the past.Since you need a seller with CPA's (capacity, powers and authority), your title insurance company will list their requirements for your seller.What we do not know is if your seller must get sale confirmed by court.

But ask yourself this, would you go invest the amount you have invested into this real estate into any franchise that you can think of and then hire people to run it for you while you hope it all works out in a largely removed capacity?
