Most leases if the subject tennent is on a lease will survive the transfer of ownership so you may not have a choice as to whether to keep the tennent or not .

The rules in NY state where I am is that closings are final, you cannot pursue after the closing, unless the P&S contract stipulates "errors and omissions shall survive the closing".

I am not sure there is a document that can protect both of you... and in today's environment just simple claim... real or imagined of abuse or hostilities and there isn't an agreement around that will survive those claims.I currently have a client who just went through the same thing.
