Typically if there is a restaurant they are required to have the black commercial grade ducts for ventilation, not just the standard HVAC ducts.Also, has the building ever been inspected by the health and safety inspector? 

Any way, the owner is not in the best of health and is really looking for someone to "buy him out" and allow him to live there till he passes away.

This is in Evanston, Illinois and I went through the daycare licensing requirements in the village website and they are pretty stringent, requiring inspections from Fire department, Health, police reports etc.

It is my belief that San Diego currently has the least LL friendly regulation (COVID related) in the country (evictions can only be for health and safety items - tenants can currently break the lease with impunity but in less than 60 days they will pay for their violations (assuming no extension)).

People generally emotionally, mentally and physically gravitate towards those who look - including possessions- and act and seem like them.

The family in the inhabited unit was on a month-to-month lease until a couple of months ago, at which point I had my attorney send them a 30-day notice of nonrenewal of lease.The tenants are effectively ignoring the nonrenewal notice, and my attorney has reached out directly to these tenants a number of times in order to offer them more time to vacate, as they are a little older, aren't in the best physical health, and have an adult son for whom they care.My attorney is communicating with the tenants on my behalf, exclusively, as I wanted to be as legally cautious as possible.The tenants are not responding to my concession to allow more time to vacate (they asked for an additional six months - unreasonable - I countered with two months), and they still claim to my attorney that we have a valid lease, despite there being a valid nonrenewal notice having been issued.
