I just received a press release from Idaho Realtors that I thought was interesting...FOR IMMEDIATE RELEASEIDAHO REALTORS® FILES SUIT TO PROTECT PRIVATE PROPERTY RIGHTS IN LAVA HOT SPRINGS (Lava Hot Springs, Idaho) – Idaho REALTORS® has filed suit against the city of Lava Hot Springs to defend the rights of private property owners and their ability to reasonably and responsibly offer short-term rentals.Utilizing the association’s legal defense fund, IR will support [property owners] in a lawsuit against the city of Lava Hot Springs for its denial of their license for a short-term rental property.

I'm not a lawyer, no legal advice, but I would think your agent would know what steps to take to find out if seller can perform any time soon and, if not, I'd figure out your current expenses and send a release asking them to return your deposit and reimburse you for any due diligence expenses you've already incurred as you were willing to close as contract stated -- they are the ones with the issue tying things up.

You still own the loan, but the company provides the opportunities, prepares the loan documents, facilitates the closing, payments, and payoff/release of lien on the backend.

However, they will not release the funds until I secure the remaining 1/3 of the funds.

Any documents signed should be held in escrow pending your approval for them to be released.
