Fair market doesn't mean what the judge determines as value, it means what the market will bear for the sale of that home within the time frame that it needs to be sold.

I was looking on Minnesota's page about this, but I'm a little confused about this:Subd. 2.Interest.Any deposit of money shall not be considered received in a fiduciary capacity within the meaning of section 82.55, subdivision 26, but shall be held by the landlord for the tenant who is party to the agreement and shall bear simple noncompounded interest at the rate of three percent per annum until August 1, 2003, and one percent per annum thereafter, computed from the first day of the next month following the full payment of the deposit to the last day of the month in which the landlord, in good faith, complies with the requirements of subdivision 3 or to the date upon which judgment is entered in any civil action involving the landlord's liability for the deposit, whichever date is earlier.

Thanks again to XXXX Underground for the fine job post 11 - basement development Developing an inner city basement has a number of elements that must be carefully orchestrated into the finished product; the hole has to get dug in the right spot, so the surveyor is essential before work begins the excavator must get the hole level and at the proper depth at the bottom of the footingthe engineer must take the sample for soil bearing and sulphate content of the soil, this will impact concrete selection later (the mix is variable depending on the project requirements)the engineer must already have developed plans for the footing rebar detail and thickness, and wall rebar pattern.

If she owes the Lender more than the market will bear for the property, then you haven't convinced me that "wholesaling this property would be a viable option in this situation".
